Through April, the disasters of March 11 were a common topic in my consultation room.
　４月までは診察室でも震災に関係した話題が多くなりがちだったが、

Now things have gotten back to normal, although "normal" simply means that patients are once again able to talk about personal issues that existed since before the earthquake.
ここに来て通常モードに戻ってきた。とはいっても、診察室の通常モードとは、「前からあった個人的な悩みが語られる」ということ。

Those issues vary from person to person.
　悩みの種類は人それぞれだ。

Bullying from a boss at work, suspicion that a boyfriend is hiding something, abusive language from a husband, inability to find a hospital that can take on a parent who needs care, a child with a developmental disorder.
職場の上司からいじめを受けている。交際中の男性にだまされている気がする。夫の暴言がひどい。介護している親を入院させる先が見つからない。子どもが発達障害で困っている。

There are as many issues as there are patients.
ほかにも患者さんの数だけ悩みがあり、聞いているだけで途方に暮れてしまう。

Through April, these issues were hidden to an extent by the enormity of the March 11 disasters, but they were in no way gone.
４月までは大震災というあまりに大きな困難に隠れて、一時的にそれまでの悩みが見えなくなっていただけで、決して消え失（う）せたわけではなかったのだ。
よく考えたら、これはあたりまえのことだ。

Adding to those issues, the earthquake and related disasters have caused some people to lose their jobs or been used as reasons to force them into excessive overtime.
　さらに、これまでの悩みに加えて、大震災の影響で仕事が減ったり解雇を言いわたされたりしている人もいる。

Some people have apparently been forced to take second loans to rebuild their lives, even while loans on their destroyed homes in the disaster areas remain unpaid.
「被災地の分も」などと言われ無理な残業を強いられている人もいる。

This extra burden on their wallets is also an extra burden on their minds.
被災地では壊れた家のローンが残っているのに新しい借金をして生活を再建させなければならないという、いわゆる二重ローンが問題になっているようだが、これはいわば“悩み、ストレスの二重ローン”だ。

Just as multiple loans can't be repaid all at once, neither can multiple psychological burdens be dealt with all at once.
　金銭的なローンもいっぺんに返せないように、心の二重ローンも一度に解決することはできない。

We mustn't be overwhelmed by feeling that the problems of the disaster have piled on to the family problems or other issues we already had.
「以前からの家庭の問題に加え、震災のダメージが……。いったいどうしたらいいんだ」とパニックにならず、

The only way forward is to take on each problem one at a time.
ひとつひとつ、問題に取り組んでいくしかないのだ。

It is important not to fall into a state where we give up on ourselves.
　その場合に大切なのは、「もうダメだ」と自暴自棄にならないということ。

We first have to calm ourselves. We can do this by, for example, reciting to ourselves, "It will be OK, it will be OK," like a chant.
「なんとかなる、なんとかなる」とおまじないのように自分に言い聞かせ、まずは気持ちを落ち着かせる必要がある。

Next is deciding the order or priority with which we will tackle our problems.
それから、どういう順番で問題や悩みに取りかかるか、優先順位を決める。

As we work on our problems, it is important to not think about too many things at a time.
その場合に大切なのは、いっぺんにあれもこれもと考えずに、

We have to put other issues aside and focus on one problem until it's finished, and then we move onto the next.
とにかくひとつを片づけたら次のひとつ、と「一度に手がけることはひとつ」というのを原則にすることだ。

This advice applies to me as well.
　私もそう。

I want to help with the psychological care of people who have returned from volunteer work in the disaster areas, but there are my normal consultations with patients and my job at the university to consider, and I can't take care of two or three things at the same time.
ふだんの病院の診療、大学の仕事に加えて、被災地ボランティアに出かけて帰ってきた人たちの心のケアをしたいと考えているのだが、一度にふたつも三つも片づけることはできない。

I'd like to make a motto for this year to be, "One at a time is enough."
「ひとつひとつでいいんだよ」というのを今年のキャッチフレーズにしよう。

先日、私のブログの記事（君が代起立問題）で、カフェの読者から私の考えが右だかあるいは左だと指摘された。
私が英字新聞の記事を毎日掲載しているのは純粋に英語のボキャブラリーを高めるためだ。
２年ほど前に、カフェのいわおさんと知り合ってからは、自分の考えも、ときどき掲載するようになった。
この数年間、読売、朝日、毎日を読み比べた。
最近の右、左は多様化しており、昔のように一枚岩ではなくなってしまっている。
しいて、私見を述べるならば、
読売は右より、朝日と毎日は左より。
でも、記事により、右側や左側にぶれることもしばしば。
そろそろ、右左で烙印を押すワンパターンな習慣から脱却する時期だと思う。
現代社会は恐ろしいほど多様化（diversity)しているのだから。
昨日、読売新聞の若い、駆け出しの記者がひき逃げされた。
なんだか、犯罪の臭いがする。
新聞記者というのも命がけの仕事なのである。

EDITORIAL: Ruling, opposition parties must end futile political battle
菅首相辞意表明―不毛な政争に区切りを

What the recent ruckus over a no-confidence motion against Prime Minister Naoto Kan put before us was a cold reality of senseless politics that dominates the nation at a time of emergency.
　見たくないものを見せられた気分だ。一連の内閣不信任騒動が示したものは、非常時の国に、非常識な政治がはびこる寒々しい現実だった。

It is highly unusual for the nation's leader to make public his intention to step down in the future without waiting for his term to expire.
　国の最高指導者が任期満了ならいざ知らず、将来の退陣を明らかにするのは極めて異例であり、重い決断だ。

Despite such a grave decision on the part of the prime minster, it does not give rise to widespread public expectations that politics will change.
　なのに、これで政治が変わるという期待感が広がらない。

This is not only because the timing of his resignation is unclear, but also because the public sees it as a result of giving priority to avoiding the Democratic Party of Japan from splitting--and nothing else.
肝心の退陣時期があいまいなうえ、ただただ民主党の分裂回避を優先させた結果にしか見えないからだ。あまりにも論理が内向きなのだ。

■辞任はやむなし

Kan was prepared to dissolve the Lower House in the event the no-confidence motion passed with a large number of dissenters from the ruling parties.
　菅直人首相は与党から大量の造反が出て、不信任案が可決されれば、衆院を解散する構えだった。

However, he changed course once he faced the situation that the no-confidence motion might eke through or at least the DPJ's splitting appeared unavoidable with many members rebelling against him.
だが、いざ不信任案が可決されかねない、少なくとも大量の造反で党の分裂は避けられないという状況に追い込まれると、方針を転換した。

In the stricken areas of the March 11 Great East Japan Earthquake, even now, some 100,000 people are still living in shelters.
　東日本大震災の被災地では、いまなお１０万人が避難生活を強いられている。

Difficult work continues at the crippled Fukushima No. 1 nuclear power plant to bring the situation under control.
Under such circumstances, Japan is in no shape to hold a general election.
福島第一原発の事故は収束への苦難の作業が続く。

とても総選挙をできる状況にはない。

On the other hand, if the Cabinet resigns en masse, such tasks as choosing a new prime minister and building the framework of a new government are likely to face difficulties and prolong the political vacuum.
一方で、総辞職をしたならば、新たな首相選びや政権の枠組みづくりが難航し、政治空白が長引きかねない。

The prime minister apparently chose to avoid political confusion above all.
　ここは、とにもかくにも政治の混乱は避けたいという選択だったのだろう。

We have been criticizing the way ruling and opposition parties were engrossed in political strife amid a crisis. 　私たちは危機のいま政争にうつつをぬかす与野党の振る舞いを批判してきた。

Although we do not like the idea that the no-confidence motion almost passed, we think Prime Minister Kan's decision to step down could not be helped in this case.
事実上、不信任案が可決されたような展開は評価できないが、菅首相の判断はこの際、やむをえなかったと考える。

Still, why is the timing unclear for his resignation, which he said he will make "once a certain level of progress has been made in dealing with the disaster?"
　ただ、首相が退陣の時期として挙げた「震災の取り組みに一定のめどがついた段階」とは、いつなのかがはっきりしないのは、どうしたことか。

Former Prime Minister Yukio Hatoyama said Kan will formally resign when a basic law for reconstruction is passed and the compilation of the second supplementary budget is in sight, not when the budget is passed.
　鳩山由紀夫前首相は復興基本法が成立し、第２次補正予算案の成立ではなく編成にめどがついた段階だとしたが、

But DPJ Secretary-General Katsuya Okada disagrees.
岡田克也幹事長は否定している。

Such an ambiguous settlement symbolizes the seriousness of the rift within the party.
　こんな決着の仕方が、党内の亀裂の深さを象徴する。

■小沢氏を除名せよ

Now that the no-confidence motion has been turned down, we have two requests for Prime Minister Kan:
　不信任案が否決されたいま、菅首相に二つの注文をする。

1) Not only expel the two party members who supported the motion, but also strictly discipline other rebels, including former DPJ leader Ichiro Ozawa who was absent when the motion was put to a vote.
　ひとつは、採決で賛成した２人の除名だけでなく、欠席した小沢一郎元代表らも厳しく処分することだ。

There is no alternative but to remove Ozawa--whose qualifications as a party member are currently being suspended--from the party roster.
党員資格停止中の小沢氏は、もう除名するしかあるまい。

To begin with, the Ozawa group, which maintains a negative stance toward the re-examination of the manifesto and the raising of the consumption tax rate, has stood in the way of reaching a bold compromise with opposition parties.
　そもそも、マニフェストの見直しや消費税率引き上げに否定的な小沢氏らのグループの存在が、野党との大胆な妥協を阻んできた。

Members of the group threatened the prime minister by saying that they would support the no-confidence motion.
その小沢氏らが不信任案に乗るぞ、と揺さぶりをかけたのだ。

Although it is doubtful whether the prime minister, who struggled to prevent the party from splitting, still has enough energy to bring the party together with disciplinary action, fewer than 20 members actually rebelled.
　分裂回避に腐心した首相に処分問題で党内をまとめる力量が残っているかどうかは心もとないが、結果として、造反は２０人以下にとどまった。

Now that the no-confidence motion has been turned down, there is no reason to hesitate to discipline the naysayers and try and unify the party.
不信任案が否決されたいま、ためらう理由はないはずだ。

2) Present a schedule with times for the transfer of the administration as soon as possible.
　もうひとつは、政権移行に向けた工程表を、できるだけ速やかに示すことだ。

When will the DPJ presidential election to choose a candidate for prime minister be implemented?
　いつ、新たな首相候補を選ぶ民主党代表選を実施するのか。

How will policies be divided into those to be implemented under the Kan administration and those to be handed over to the new administration?
菅政権のもとで実現をめざす政策と、次の政権に委ねる政策の仕分けをどうするのか。

The administration should also clarify how it will produce necessary funds for the second supplementary budget.
　たとえば、社会保障と税の一体改革はどうするのか。第２次補正予算案の財源をどう賄うのかも明確にすべきだ。

■旧世代は総退陣を

In particular, the party should spend adequate time on choosing its next leader by carefully examining his or her qualifications.
　とくに、次の指導者選びには時間をかけて、その資質の真贋（しんがん）を吟味しなければならない。

A year ago, Hatoyama and Ozawa resigned together as prime minister and the party's secretary-general, respectively.
（一年前、鳩山氏と小沢氏は同時に辞任した。総理大臣と幹事長だった。）

　その際のキーワードは、菅首相が「若い世代に責任を引き継ぎたい」と述べた、まさにその「世代交代」だ。

It was the "troika" of these two plus Kan, who played the leading roles in the fracas over the no-confidence motion.
　この不信任騒動で表に立ったのは、民主党ではちょうど１年前に首相と幹事長を「ダブル辞任」した鳩山、小沢両氏と菅氏の「トロイカ」だった。

In the Liberal Democratic Party, those who led the move to submit the no-confidence motion at an early stage were veteran members, including former prime ministers and faction leaders.
　自民党で不信任案の早期提出を唱えていたのは首相経験者や派閥の領袖（りょうしゅう）クラスの長老、ベテランである。

Some midlevel and younger lawmakers voiced concern over developing a power struggle transcending sectarian groups amid a national crisis.
　中堅・若手の間では、党派を超えて、危機のさなかに権力闘争をやっていていいのかという声があがっていた。

Kan said, "I want to pass on responsibility to a younger generation." The key phrase here is: "a younger generation."
（菅首相は若い世代の責任を引き継ぎたいと述べていた。キーワードは若い世代。）

At this juncture, we want all lawmakers of the old generation who cannot personally identify with popular will to step down.
この際、民意を肌で感じられない旧世代には総退陣してほしい。

The process to choose the new DPJ president should be the first step.
新しい民主党の代表選びを、その第一歩にすべきだ。

Both the LDP and New Komeito hastened to submit the no-confidence motion without choosing candidates for prime minister to succeed Kan or preparing the framework of a new administration or policy systems.
　自民・公明両党は、首相候補も政権の枠組みも政策の体系も明示しないまま不信任案の提出を急いだ。

Their method did not live up to their claim of "responsible opposition parties."
まったく「責任野党」の名に値しないやり方だった。

Although they said they will continue to oppose the administration, now that Kan made public his intention to resign, it would be reasonable for them to cooperate in passing bills, such as the basic legislation for reconstruction and a bill for special public bonds to finance revenues for this fiscal year's budget.
今後も対決姿勢を続けるというが、菅首相はとにかく退陣を口にしたのだ。こうなれば、復興基本法案や今年度予算の財源を賄う特例公債法案の成立には協力するのが筋だろう。

Four former prime ministers abandoned their administration after a year or so--one after another. Kan took over the reins of the government after them. It seems likely that his administration will also be short-lived.
　過去４代、たて続けに１年前後で交代した首相のあとを受けた菅首相も、短命に終わりそうだ。

The foreign media reported that the Japanese prime minister is set to change again.
海外には「またまた日本の首相が代わる」というニュースが配信された。

The current revolving door of prime ministers is a big disadvantage for Japanese diplomacy.
外交にとって、大きなマイナスだ。

This brawl over a no-confidence motion must at least serve as an opportunity for ruling and opposition parties to end a futile political battle and to make a fresh start for the realization of policies for the public.
　せめて、この不信任騒動を、与野党が不毛な政争に区切りをつけ、国民のための政策実現に向け再出発する機会にしなければいけない。

テレビのニュースでこの一連のドタバタ悲喜劇をみていた。
異常に興奮している鳩山さんが印象的だった。
「ペテン師」発言には、ペテン師はお前もだろって叫んだ。

大体、鳩山兄弟はろくなもんじゃない。
鳩山邦夫元法務大臣は現職中、フィリピンで趣味の蝶採取の違法行為をした。
フィリピンではこの蝶の捕獲は法律で禁止されている。
捕獲網のカーボンロッドが高圧線に接触、感電事故を引き起こし、フィリピン大使館職員が２名死亡している。
十分な遺族補償もなしに日本に逃げ帰って、あとはなしのつぶて。
遺族である娘さんを、日本のお坊さんがひきとって面倒みている記事が掲載されていた。

まるで忍者のように突然姿を消した小沢さん。
梯子を突然はずされてオロオロしている熱血正義感の議員がインタビューされていた。
それでも、まだ小沢さんをかばっていた。
ＫＹ（空気が読めない）とこうなる。
大半の議員二十数名は空気を読み、小沢さんのように投票を棄権した。

被災者は、あきれかえってテレビの報道に見入っていた。

疲れました。

Parties must unite to form strong post-Kan cabinet
首相退陣表明　「ポスト菅」で強力政権を作れ（6月3日付・読売社説）

　◆与野党連携で迅速な復興を◆

What was the point of delaying the resignation of Prime Minister Naoto Kan? In the end, the various problems the Kan administration is facing were just put off to be solved at some future date.
　首相退陣を引き延ばすことに一体何の意味があるのか。結局、菅政権の抱える問題を先送りしただけである。

On Thursday, Kan announced his intention to step down from his post when restoration efforts from the Great East Japan Earthquake and the response to the crisis at the Fukushima No. 1 nuclear power plant operated by Tokyo Electric Power Co. are settled to some degree.
　菅首相が、東日本大震災の復旧・復興と東京電力福島第一原子力発電所事故対応に一定のメドがついた段階で退陣する意向を明らかにした。

As the vote approached on a no-confidence motion submitted by the opposition parties against the Kan Cabinet, support for the motion expanded within Kan's Democratic Party of Japan. This led to the very high possibility of a split in the party even if the no-confidence motion was defeated.
　内閣不信任決議案の採決を控え、民主党内から造反の動きが拡大し、否決されても党が分裂状態になる可能性が強まっていた。

The result can be regarded as a very "inwardly focused" announcement of resignation by Kan, coming after he was persuaded by former Prime Minister Yukio Hatoyama and others who feared a party split as well as a dissolution of the House of Representatives for a general election if the motion passed the chamber.
　党の分裂や、可決による衆院解散・総選挙を懸念した鳩山前首相らに説得された末の“内向き”の退陣表明と言えるだろう。

The no-confidence motion was voted down in the lower house, but 17 DPJ members either rebelled to vote in favor, abstained or did not attend the vote. This is not a small number.
　衆院で不信任案は否決されたが、民主党議員の造反は１７人に上る。少ない数ではない。

Kan must clarify when he'll quit
　◆明示すべき辞任の時期◆

The primary responsibility for the government and ruling parties' inability to respond quickly and flexibly to the disasters in a united manner of course rests with Kan, the prime minister.
　政府・与党が一丸となった機動的な震災対応ができないことの一義的な責任は無論、菅首相にある。

We urge him to seriously reflect upon the matter.
猛省を求めたい。

We believe it is a serious problem that Kan did not make clear when he will step down.
　問題は、首相が退陣時期を明示しなかったことにある。

According to points confirmed through a memorandum Hatoyama and Kan exchanged Thursday, the only part that may be regarded as relating to his resignation is "deciding a schedule for early compilation of a fiscal 2011 supplementary budget."
　菅首相と鳩山氏が交わした覚書の確認事項によると、退陣時期に関連する部分は、「第２次補正予算の早期編成のめどをつける」とされているだけだ。

At a press conference after his "announcement" of his intention to resign, Kan said he would do his best to bring the nuclear crisis in Fukushima Prefecture under control and even talked about the possibility of considerably delaying his resignation.
　首相は退陣表明後の記者会見で、原発事故の収束に努力する考えを示し、辞任を大幅に先延ばしする可能性にまで言及した。

What he said Thursday night strongly contradicted what he said earlier in the day. Even members of his party are voicing strong opposition to Kan's attitude.
これでは話が食い違う。民主党内からも強い反発が出ている。

It is quite irresponsible for Kan to take the helm of the government in such a halfway manner.
　こんな中途半端な形で政権を担い続けるのは、無責任である。

He should remember that those hit by the great earthquake and tsunami are still living in severe conditions.
　震災の被災者は、今なお厳しい環境に置かれている。

A Diet session in which nothing can be decided continues, which may cause paralysis in national politics.
　「何も決められない国会」が続き、国政が停滞する。

Other countries may realize this administration is weakening, resulting in uncertainty as to whether the nation can rebuild its international relations.
政権弱体化を見透かされ、国際関係の再構築もおぼつかない。

Such a situation should be avoided by all means.
そうした事態は回避しなければならない。

To avoid dysfunction in politics, the period until Kan's resignation must be as short as possible.
　政治の機能不全を避けるため、退陣までの期間はできるだけ短くすべきである。

Pass 2nd extra budget quickly
　◆２次補正予算が急務だ◆

To realize swift passage of legal revisions and new bills related to reconstruction and relief measures under the divided Diet, it is essential for the government and ruling parties to cooperate with the opposition parties.
　ねじれ国会の下、震災関連の立法措置を迅速にとるためには野党との連携が欠かせない。

Kan must make clear when he will step down and directly ask Liberal Democratic Party President Sadakazu Tanigaki and other opposition leaders for cooperation.
　首相は明確に期限を切り、自民党の谷垣総裁らに協力を直接要請すべきだろう。

The first thing he must do to that end is drastically revise the party's manifesto for the 2009 lower house election, which stipulates dole-out policy measures such as child-rearing allowances and basically eliminating all expressway tolls.
　そのためには、まず、子ども手当や高速道路無料化などバラマキ政策を掲げた政権公約（マニフェスト）の大胆な見直しが要る。

Former DPJ President Ichiro Ozawa and some other DPJ lawmakers, who were not present at Thursday's vote, have been insisting on adherence to the party's election pledges, which have virtually failed already, preventing cooperation with the opposition parties.
　採決で欠席した小沢一郎元代表らは、すでに破綻した政権公約の順守を主張し、野党との連携を阻んできた。

The prime minister needs to make drastic policy changes by punishing Ozawa and the other rebel members severely, who could be dubbed "manifesto supremacists."
　菅首相は、「マニフェスト至上主義」と言える小沢氏ら造反議員を厳しく処分し、それをテコに大胆に政策転換する必要がある。

Secure sufficient revenue

Swift action must be taken to enact a basic disaster reconstruction bill, as well as to quickly compile and pass the second supplementary budget for fiscal 2011.
　急ぐべきは、復興基本法案の成立はもとより、震災復興を目的とする第２次補正予算案の早期編成・成立である。

To realize the latter, the ruling coalition should start close talks with the opposition in the drafting process.
そのためにも、編成の段階から野党側と緊密に協議することが望ましい。

The second supplementary budget, focusing on heightened restoration efforts, is expected to be much larger than the first one, which focused mainly on the reconstruction of infrastructure.
　第２次補正予算案は、復旧中心の１次補正予算をはるかに上回る規模になる見通しだ。

Since measures dealing with the disaster will remain in effect for a long time, it is a priority issue for the government to secure financial resources for them.
　震災対策は長期にわたる。その財源の確保が課題だ。

The government and the ruling coalition are studying a plan to issue bonds that will be used only for reconstruction purposes.
　政府・与党内では、復興目的に使途を限定した復興債を発行する案が検討されている。

Some tax hike cannot be avoided.
　何らかの増税は不可欠だ。

If the burden of reconstruction is considered something that should be shared equally but lightly by the public, we think it is realistic to raise the consumption tax rate.
国民が広く薄く負担するという観点からは、消費税率の引き上げが現実的だろう。

The government and the ruling coalition must discuss such financial sources for reconstruction frankly with the opposition parties.
　こうした復興財源について、政府・与党は、野党と率直に話し合っていかねばならない。

At the moment, we cannot expect much from Kan, who has already revealed his lack of leadership and decisiveness.
　指導力や決断力の欠如を露呈した菅首相には、当面、多くは期待できない。

However, he should at least pave the way for a new administration to succeed his Cabinet.
だが、「ポスト菅」の新体制への移行だけはしっかりと道筋をつけてもらいたい。

Drastic policy changes needed
　◆政権公約の抜本改定を◆

When he indicated his intention to resign Thursday, Kan said, "I would like to pass the responsibility on to a younger generation."
　首相は、退陣表明の際、「若い世代に責任を引き継いでいきたい」と述べた。

This apparently expresses his feeling that Ozawa and Hatoyama should not be allowed to have any influence in the future.
小沢、鳩山両氏には影響力を持たせまいとする気持ちの表れだろう。

We would like to suggest that candidates should have vigorous discussions on how to depart from the party's manifesto and compete over new, realistic policies in the DPJ presidential election to choose Kan's successor.
　菅首相の後継を選ぶ党代表選では、「脱マニフェスト」を巡って活発に論争し、現実に沿った新たな政策を競ってはどうか。

Tanigaki has been claiming the LDP is ready to work with the DPJ if Kan is replaced as prime minister.
　谷垣総裁は、菅首相さえ交代すれば、民主党と協力する用意があると主張してきた。

Now, as a responsible political party, the LDP must rebuild cooperative relations with the DPJ to prepare for the prime minister's resignation.
菅首相の退陣に備え、民主党との協力関係を再構築するのが、責任政党としての務めである。

Young and mid-level lawmakers of both the DPJ and the LDP have organized joint study groups on policies, fostering momentum for cooperation.
　民主、自民両党の中堅・若手議員は政策勉強会などを結成し、連携の機運が醸成されている。

Such movements should be valued.
この動きを大事にしたい。

The administration that succeeds the Kan Cabinet must face the national crisis by forming a grand coalition and should show specifics on how Japan will be revitalized.
　「ポスト菅」政権は、大連立によって国難に立ち向かい、日本再生への具体像を提示すべきだ。

この記事の骨子は多数決には賛成だが少数意見も尊重しなければならない、だと思います。
妥当な記事だと思いますが、皆さんのご意見はいかがでしょうか？
そもそも、思想・良心の自由を保障する憲法の条項をたてにして、厳かな儀式のとき騒ぐ人のほうがおかしい。
議論するのはかまわないが、儀式中、儀式の雰囲気を損なう行為はやめて欲しいものだ。
そういう人は、もともと教員には不向きなのだと考えます。

EDITORIAL: Decision on 'Kimigayo' evades crucial question of minority rights
君が代判決―司法の務め尽くしたか

Supreme Court justices are allowed to write their own opinions on controversial cases that are separate from the court's majority opinion.
　最高裁の裁判官は、多数決で決まる法廷意見とは別に、個別意見を表明することができる。

Whether they express concurring or dissenting opinions, these statements help us better understand the court's position on a given issue by providing arguments and observations that are not included in the majority opinion.
結論に反対する内容ではなくても、最大公約数である法廷意見の足りない点を補い、意のあるところを説くことで、判決をめぐる議論と理解は深まる。

The Supreme Court ruled on May 30 that a Tokyo public high school principal who ordered faculty members to stand and sing the "Kimigayo" national anthem during a graduation ceremony did not violate Article 19 of the Constitution, which guarantees freedom of thought and conscience.
　卒業式などの君が代斉唱の際、都立学校の校長が教員に起立斉唱を命じても、思想・良心の自由を保障する憲法に違反しない――。

But the verdict was accompanied by lengthy opinions written by the justices.
そう述べた判決にも長文の補足意見がついた。

Presiding Justice Masahiko Sudo of the court wrote: "If teachers become fearful and suspicious of one another because the enforcement (of singing the national anthem) entails disciplinary measures against noncompliers, the spirit of education will die."
　「不利益処分を伴う強制が、教育現場を疑心暗鬼とさせ萎縮させることがあれば、教育の生命が失われる」

Sudo also called for the "utmost restraint" in the enforcement of this practice and any rendering of adverse dispositions.
「強制や不利益処分は可能な限り謙抑的であるべきだ」（須藤正彦裁判長）、

And Justice Katsumi Chiba noted, "It is important to create an environment in which any display of respect for the national anthem and the national flag will be spontaneous, not forced."
「国旗・国歌が強制的にではなく、自発的な敬愛の対象となるような環境を整えることが重要だ」（千葉勝美裁判官）。

We have repeatedly made the same arguments. The Supreme Court acknowledged in its majority opinion that the principal's order indirectly limited freedom of thought and conscience, but said that the constraint is permissible in view of the established history and meaning of the ceremony in question and the status of teachers as public servants.
　いずれも私たちが繰り返し主張してきたことと重なる。法廷意見も、職務命令が思想・良心の自由の間接的な制約になると認めた。そのうえで、長年の慣例や式典の意義、公務員の立場などを考えれば、そうした制約も許され得るとしている。

We should note that the highest court was not unconditional in ruling this case constitutional.
　手放し、無条件の合憲判断ではないことに留意しよう。

We stress this point to the nation's educational administrators, and especially to Osaka prefectural assembly members, who will be voting soon on a draft ordinance that would oblige teachers to stand during the singing of the national anthem.
教育行政に携わる人、そして起立条例案の採決が迫る大阪府議会の関係者は、判決の趣旨をしっかり理解してほしい。

But we are frankly disappointed with the Supreme Court, and we cannot trust it.
　一方で、最高裁の姿勢には疑念と失望を禁じ得ない。

The plaintiff, a former teacher, was reprimanded for refusing to stand just once.
　原告の元教員は１度だけ起立を拒み、戒告処分を受けた。

But even though he obeyed the principal's order later on so as not to further disrupt the ceremonies, he was refused re-employment as a contract worker when he reached his mandatory retirement age.
その後は現場を混乱させたくないとの思いで命令に従ったが、定年後の再雇用を認められなかった。

However, the school re-employed another teacher who had been disciplined much more severely for a different reason. This teacher had been suspended and had his salary cut.
ところが、別の理由で停職や減給などもっと重い処分を受けた教員は採用された。

The Tokyo District Court ruled that the school abused its discretionary power by treating the plaintiff unfairly in comparison with the other teacher, but this ruling was reversed by the Tokyo High Court.
The Supreme Court effectively upheld the appellate court's decision by examining only the constitutionality of the principal's order and not going into the appropriateness of the school's decision not to re-employ the plaintiff.
　一審の東京地裁は扱いの不均衡を踏まえ、裁量権の乱用があったとしたが、最高裁は職務命令と憲法の関係のみを論じ、不採用の当否は判断しなかった。結果として、原告が逆転敗訴した二審判決が確定した。

This was an important issue, and the Supreme Court could easily have addressed it, had it wanted to. But it did not, which forces us to conclude that it dodged the issue on purpose.
　最高裁にその思いがあれば審理できるにもかかわらず、そしてそれに値する重要な問題であるのに、あえて避けたとしか思えない。

In failing to come to the plaintiff's rescue, the Supreme Court undermined its own plausibility in its call for "careful consideration" of the matter in its verdict.
このようなケースにすら救いの手を伸べず、ただ判決文の中で「慎重な配慮」を求めても説得力に欠けよう。

The judiciary's important mission is to stand up for the minority by not being influenced by the wishes of the majority or prevalent social trends.
　多数者の意向や勢いに流されず、少数者を保護する。それが司法の大切な使命だ。

The legal profession must be especially thorough and discriminating when dealing with cases involving freedom of thought, conscience, expression or religious belief.
とりわけ思想、良心、表現、信教など精神的自由に関する分野では、厳格なチェックが求められる。

When a court of law abandons that responsibility, our society loses its diversity and will eventually decline.
　裁判所がその職務を放棄したとき、私たちの社会は多様性を失い、やがて色あせていく。

EDITORIAL: China not the only country needed to push reforms in North Korea
北朝鮮―強まる一方の中国頼み

North Korea's close ties with China, its ally in the Korean War (1950-1953), have traditionally been described as "friendship cemented with blood." Now, however, it seems their relationship is based more on the practical needs of both sides than on their shared memories of the war.
　朝鮮戦争をともに戦い、「血で固めた友誼（ゆうぎ）」と伝統的に言われてきた北朝鮮と中国も、互いに利用し合う現実的な関係になっているようだ。

That may be the reason why the hug between North Korean leader Kim Jong Il and Chinese President Hu Jintao during their meeting in Beijing last week looked somewhat formal and distant.
　先週の北京での首脳会談で、金正日（キム・ジョンイル）総書記と胡錦濤（フー・チンタオ）国家主席が交わした抱擁がどこか儀礼的で、よそよそしく見えたのも、そのせいかもしれない。

Even so, North Korea is becoming more dependent on China, both economically and diplomatically.
　とはいえ、経済的にも外交面でも、北朝鮮の中国依存は強まるばかりだ。

Kim's latest visit to China is the third in about a year--unusual frequency.
今度の金総書記の訪中は、この約１年で３回目という異例の頻度である。

Since his previous visit to China, North Korea has shown its uranium enrichment facility to a U.S. expert and fired artillery at a South Korean island. These actions by Pyongyang have made the security situation in the Korean Peninsula even more serious.
　前回の訪中以降、北朝鮮はウラン濃縮施設を米国の専門家に見せ、韓国の島を砲撃し、事態はより深刻になっている。

If so, it is all the more important for China to use its clout with North Korea more forcefully to persuade the hermetically sealed regime in Pyongyang to behave in a way that will help break the diplomatic impasse over its nuclear program and other issues.
　ならば一層のこと、中国は北朝鮮への影響力を活用し、核問題など北朝鮮をめぐる膠着（こうちゃく）した状態を打開すべく、説得をもっと強めてもらいたい。

Explaining Kim's visit to China in his recent talks with South Korean President Lee Myung-bak, Chinese Premier Wen Jiabao said Beijing gave the North Korean leader an opportunity to learn how China has achieved its economic growth and use the knowledge for the sake of his own country.
　中国の温家宝（ウェン・チアパオ）首相は訪中について、李明博（イ・ミョンバク）・韓国大統領に対し「中国の発展ぶりを理解し、自国に活用する機会を与えるため」と説明した。

Wen's remarks indicate Chinese leaders are hoping to see North Korea start taking steps toward meaningful reforms so that the impoverished nation will not collapse and plunge into total chaos, thereby causing serious trouble to China.
北朝鮮が行き詰まって崩壊しないよう、つまりは中国も余計な迷惑を受けないよう、北朝鮮に改革へのカジを切ってほしいのだろう。

As if acting in accordance with Beijing's wishes, Kim inspected afresh economically advanced areas during his stay in China.
By doing so, Kim apparently wanted to secure China's strong support for his country's struggle to revive its dilapidated economy just as it is preparing for the centennial of the birth of Kim Il Sung, the late founder of the nation and father of its current leader.
　金総書記はそれに沿うかのように、改めて経済先進地を視察したが、来年の故金日成（キム・イルソン）主席生誕１００年の節目を控え、困窮する経済の再生へ、中国の強力な協力を求める目的があっただろう。

The 69-year-old Kim Jong Il's eight-day trip to China also demonstrated the recovery of his health.
６９歳の金総書記は８日間にわたる長旅をこなし、体調の回復ぶりも誇示した。

China accounts for most of North Korea's trade. Recently, China has embarked on development of North Korean islands close to their border and improvements of ports and roads in the isolated country. China has also been a vital supplier of food and energy to North Korea.
　北朝鮮の貿易の大半は中国が占める。最近、国境地域にある北朝鮮側の島の開発、港湾や道路の整備にも、中国は本格的に乗り出しつつある。食糧やエネルギーの支援でいえば、もともと中国の存在は不可欠だ。

No matter how much influence China may have on North Korea, other countries should not, of course, leave the efforts to extract changes from the regime totally in the hands of Beijing.
　もちろん、いかに中国の影響力があるからといって、それに任せるだけではいけない。

Japan, the United States, South Korea and Russia should make serious efforts of their own to pressure Pyongyang into taking steps forward.
日米韓やロシアも、北朝鮮を前に動かす知恵を絞らねばならない。

In order to break the diplomatic stalemate, North Korea should first begin to show a sincere attitude toward South Korea.
　行き詰まりからの脱却には、まず北朝鮮自身が韓国に対して誠実な対応を取る必要がある。

During his recent meeting with China's Hu, North Korea's Kim stressed the importance of denuclearization of the Korean Peninsula and an early resumption of the suspended six-nation talks over his country's nuclear ambitions.
He said his country is currently concentrating on economic development and needs a stable diplomatic environment.
　金総書記は今回の胡主席との会談で、「経済建設に集中している。安定した周辺環境が必要だ」と語り、朝鮮半島の非核化と６者協議の早期再開を主張した。

Regarding his country's soured relations with South Korea, Kim reportedly said he sincerely wished for improvement. It is good to hear him say so. We hope he will match his words with action.
悪化したままの韓国との関係も「改善を心から望む」と述べたという。その言やよし、実際の行動で示してほしい。

North Korea's litany of woes due to its seemingly permanent stagnation has serious implications for Japan.
　停滞感に覆われる北朝鮮だがひとごとではすまない。

In addition to the issues of the country's nuclear and missile programs and its past abductions of Japanese citizens, the fate of the regime itself has direct bearing on Japan's national security.
核とミサイル、拉致問題のみならず、体制の行方そのものが日本の安全保障に直結している。

We need to keep close watch on this neighbor.
注視を続けなくてはならない。
